Terms of Service
Terms governing use of the LexDigital website. Client engagements are governed by a separate signed agreement.
Important: LexDigital is a marketing agency, not a law firm. This website does not provide legal advice, create an attorney-client relationship, or guarantee any ranking, lead, signed case, or financial result.
Acceptance and scope
By accessing or using this website, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the site. These terms apply only to the website. Any proposal, statement of work, master services agreement, or other signed client agreement controls the services we provide and will prevail if it conflicts with these website terms.
Not legal advice
LexDigital LLC is a digital marketing agency serving personal injury law firms. We do not practice law. Website content is general business and marketing information, not legal advice. Submitting a form or communicating with us does not create an attorney-client relationship, fiduciary duty, or duty of confidentiality. Do not submit privileged or confidential case information.
No guaranteed results
Search rankings, advertising costs, lead volume, lead quality, signed cases, and financial performance depend on market conditions, competition, budgets, platform rules, intake practices, and other factors outside our control. Examples, illustrations, testimonials, and past results are not guarantees of future performance. Unless a signed client agreement expressly states otherwise, we make no promise of a particular ranking, cost per lead, return, or case outcome.
Acceptable use
You may use the site for lawful business evaluation and communication. You may not:
- Copy, reproduce, republish, sell, license, or exploit site content without written permission.
- Use automated means to scrape, harvest, or extract content or personal information, except search crawlers that follow our robots.txt.
- Probe, scan, test, circumvent, or interfere with the security or operation of the site.
- Upload malicious code, impersonate another person, submit unlawful content, or use the site for unsolicited messages.
- Use the site in a way that infringes rights, violates law, or imposes an unreasonable load on our systems.
We may restrict or terminate access when we reasonably believe these terms have been violated.
Intellectual property
The website, including its text, design, graphics, code, brand elements, and arrangement, is owned by LexDigital LLC or its licensors and is protected by intellectual property law. No right or license is granted except the limited right to use the site under these terms. LexDigital names, logos, and marks may not be used without prior written permission.
Submissions
You represent that information you submit is accurate, lawful, and provided with appropriate authority. You authorize us to use it to respond to your inquiry, evaluate a potential engagement, and provide services if we enter a client agreement. Our handling of personal information is described in the Privacy Policy.
Third-party services
The site may link to or reference third-party websites, platforms, products, and services. We do not control them and are not responsible for their availability, security, content, policies, or performance. A link or reference does not imply endorsement. Your use of a third-party service is governed by that provider's terms.
Availability
We may modify, suspend, remove, or discontinue any part of the site at any time. We do not guarantee that the site will be uninterrupted, error-free, secure, or compatible with every device or browser.
Disclaimers
To the fullest extent permitted by law, the website and its content are provided "as is" and "as available", without warranties of any kind, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability. Nothing on the site should be the sole basis for a material business, financial, or legal decision.
Limitation of liability
To the fullest extent permitted by law, LexDigital LLC and its members, employees, contractors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the website.
Nothing in these terms limits liability that cannot legally be limited or excluded. Any liability arising from paid services is governed by the applicable signed client agreement.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless LexDigital LLC and its members, employees, contractors, and agents from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the site, your submitted content, or your violation of these terms.
Professional obligations
This website markets business services to law firms; it does not advertise legal services to consumers. Law firms remain responsible for complying with attorney advertising, solicitation, privacy, recordkeeping, and professional-conduct rules in every jurisdiction where they practice or market. A signed client agreement may allocate specific compliance responsibilities for a campaign.
General terms
These terms are subject to applicable law and any controlling signed client agreement. If a provision is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these terms without our written consent. These terms, together with incorporated policies, are the entire agreement governing use of the website.
Changes
We may update these terms as the website or law changes. The date at the top identifies the latest revision. Your continued use after revised terms take effect constitutes acceptance of the revised terms.
